Agency for the Protection of Competition has established that the requirements for the application of MEO test have not been met, according to the Law on Investment in the consolidation and Development of Montenegro Airlines (MA).
Decision of the Council of the Agency has ordered Ministry of Transport to suspend allocation of money to MA.
Investigative procedure with the aim of assessing harmonization of the provisions of the Law on Investment in the consolidation and Development of Montenegro Airlines with the Law on State Aid Control will be initiated ex officio.
“Ministry is ordered to submit to the Agency the state aid application form, as well as other information required for the assessment of the harmonization of state aid with the Law on State Aid Control, within 30 days from the day this decision is received”, the decision states.
The statement of reason reminds that Stabilization and Association Agreement between the EU and signatory country, constitutes the framework of relations for mutual cooperation and approximation to EU standards. This agreement defines liabilities of the future candidate for the EU membership, primarily in terms of the adoption of specific laws and implementation thereof.
“Article 73 of the Stabilization and Association Agreement defines that any state aid that damages or threatens to undermine competition by favoring specific legal entities or specific products shall be prohibited”.
This decision is final and subject to appeal.
