New labor law: Obligatory severance payments and longer annual leave for disabled workers

The proposal for the draft Labor Law that is to introduce novelties regarding the protection of persons with disabilities, but also parents of children with disabilities, has been in parliamentary procedure. 

According to the proposed amendments, employers will have to reassign disabled workers to a job position corresponding to their qualification and capabilities, based on the assessment by a competent body. If that’s not possible, disabled persons will be granted other rights in line with the law and the service-level agreement.

If there are no alternative solutions for people with additional needs, the employer may determine that there’s no need to hold that person anymore, but, in that case, the disabled worker is entitled to severance payment. 

In addition, the amendments clearly stipulate disabled employees can’t be transferred to a job position outside their place of residence without their consent, and are entitled to an annual leave – a minimum of 26 working days.
