Montenegrin MP Dejan Djurovic has proposed amendments to the Law on the Legalisation of Illegal Buildings. The main changes would extend the deadline for registering illegally constructed buildings in the cadastre from 12 to 24 months and introduce compensation for members and secretaries of legalisation commissions.
The proposal argues that many property owners were unable to meet the current deadline due to unresolved inheritance cases, ownership issues, and other administrative or legal obstacles beyond their control. Extending the deadline is intended to prevent large numbers of demolition orders that could have serious social consequences for families living in these buildings.
The amendments would also allow local legalisation commissions to receive payment for their work, with property owners covering the costs of on-site inspections. The ministry would determine the fees. The change is proposed because municipalities reportedly lack funds to compensate commission members, which could slow down the legalisation process.
Since the legalisation process began, more than 59,500 applications have been submitted, but only 3,217 legalisation decisions have been issued. The proposed changes aim to speed up the process and ensure more consistent implementation across municipalities.
